The human sciences—including psychology, anthropology, and social theory—are widely held to have been born during the eighteenth century. This first full-length, English-language study of the Enlightenment sciences of humans explores the sources, context, and effects of this major intellectual development. The book argues that the most fundamental inspiration for the Enlightenment was the scientific revolution of the seventeenth century. Natural philosophers from Copernicus to Newton had created a magisterial science of nature based on the realization that the physical world operated (...) according to orderly, discoverable laws. Eighteenth-century thinkers sought to cap this achievement with a science of _human_ nature. Belief in the existence of laws governing human will and emotion; social change; and politics, economics, and medicine suffused the writings of such disparate figures as Hume, Kant, and Adam Smith and formed the basis of the new sciences. A work of remarkable cross-disciplinary scholarship, this volume illuminates the origins of the human sciences and offers a new view of the Enlightenment that highlights the period's subtle social theory, awareness of ambiguity, and sympathy for historical and cultural difference. This Article examines the influence of the Americans with Disabilities Act (ADA) on affective attitudes toward children with disabilities and on the incidence of disability-selective abortion. Applying regression analysis to U.S. natality data, we find that the birthrate of children with Down syndrome declined significantly in the years following the ADA's passage. Controlling for technological, demographic, and cultural variables suggests that the ADA may have encouraged prospective parents to prevent the existence of the very class of people the Act was (...) designed to protect. We explain this paradox by showing how specific ADA provisions could have given rise to demeaning media depictions and social conditions that reinforced negative understandings and expectations among prospective parents about what it means to have a child with a disability. We discuss implications for reproduction law and antidiscrimination policy. (shrink)

Lapo da Castiglionchio the Younger was a Florentine Renaissance humanist who died in 1438 at the age of thirty-three. He took part in one of the most interesting phases of Italian Renaissance humanism and achieved in his short lifetime a modest reputation as a first-rate Greek to Latin translator. Less well known is the fact that he wrote a fair amount of prose works. One of the most interesting of these is a treatise which he composed in the year of (...) his death, entitled De curie commodis, or, On the Benefits of the Curia, a portrait of the papal Curia which is written elegantly, learnedly, earnestly, and angrily. ;The goal of this study is to discuss this dialogue in its intellectual and social contexts; there are three chapters. The first is a general introduction to Lapo's life and work, to the dialogue itself, and to the historiography on the De curie commodis. The second chapter discusses the manner in which Lapo employs the virtues in a Stoicizing fashion as persuasive tools in the environment of Italian humanism. It is argued that his particular treatment of the virtues can serve as a key for interpreting the dialogue as a whole. The third chapter touches both on social historical issues in the De curie commodis and on Lapo's defense or curial wealth. ;There has been no adequate edition of the Latin text, based on a wide enough variety of extant manuscripts, nor has the De curie commodis ever been translated into English . Therefore, a thorough critical edition of the Latin text along with an annotated English translation follows the discussion. ;The treatise has been notoriously difficult to interpret and seems often to prevaricate. The interpretive conclusion of this study is that Lapo wrote as a well-informed but liminal figure in the socio-cultural environment of the papal Curia--as an outsider who desired to become a full-fledged insider. The De curie commodis is not the parting shot of a fed-up hanger-on; it is instead Lapo's last-ditch, highly critical but nonetheless sincere attempt to find a patron who would allow him to join a cultural ambient at which he marvelled but from which he felt himself unjustly excluded. Walter M. Miller, Jr.’s 1959 novel A Canticle for Leibowitz is on one level a theological reflection on the human propensity to sin. Not coincidentally, the story is located in an Albertinian abbey in the former American southwest six hundred years after a nuclear holocaust, recounting three separate historical periods over the following twelve hundred years: a dark age, a scientific renaissance, and finally a time of technological achievement where a second nuclear holocaust is imminent. Miller asks the question of (...) whether humans as a species cannot avoid committing acts of sin that cumulatively and continually lead to acts of societal and technological self-destruction; his response oscillates between a fatalistic pessimism (the final extinction of the human species) and a vague optimism (the “new creature,” the mutant Rachel, or perhaps a last group of humans leaving the Earth as the curtain falls). It is my thesis in this article that theological questions about sin (as explored by Augustine and later scholars) can be fruitfully approached by analogous genetic processes; more precisely by reference to the rising science of Epigenetics, which explores how genes can express themselves differently without mutating in response to life stressors. In light of the idea of a genetic and epigenetic expression of moral rules of existence, Augustine’s thesis of original sin as something that is inherited makes new sense. In this light, it may also be possible to approach the question that the Canticle proposes: are we destined to self-destruction, or is there a way out of this destructive cycle? (shrink)

Aristotle’s Metaphysics Λ.7 features an argumentative progression from the unwavering actuality of the unmoved mover through its necessity to its goodness, which goodness in turn grounds the manner in which it serves as the ultimate principle of motion, namely, by being an object of love and desire (1072b4-12). One link in this progression is especially brief and startling, namely the second of two inferences in this short sentence: “It is a being of necessity, therefore, and in so far as [it (...) exists] necessarily, [it exists] finely, and it is in this way a principle” (1072b10-11). Aristotle slides smoothly from: x exists necessarily (ex anagkēs) to x exists finely (kalōs), without any intervening step. The seamless speed of this step is bound to give us pause—we naturally read it as enthymematic and start casting about for an intervening premise set. Still more arresting is its apparent move from a descriptive to a normative proposition. From our post-Humean vantage point we may be likely to presume that whatever the missing premise set of this inference turns out to be, somewhere buried in that set will need to be something of the form: if descriptive proposition (DP), then normative proposition (NP). Otherwise, Aristotle’s conclusion will have illicitly inferred a normative proposition from a descriptive premise set, in violation of the Humean edict that one cannot infer an ought from an is. Yet, if we smuggle the norm into our premise set along the way, we have merely relocated our problem. For then we will have asserted, or assumed, that the truth of some descriptive proposition is sufficient for the truth of some normative proposition, namely the consequent of the conditional: if DP, then NP. At any rate, this obtains unless necessity itself is already a normative notion, a questionable assumption, but one we will consider in due course. In either case, though, we need some explication of the route Aristotle follows when he moves, without comment, from necessity to goodness. (shrink)

At first glance, this title might seem a bit over the edge: how could an author intelligently juxtapose such diverse thinkers as an ecological scientist, two advocates of human rights, and an ancient religious founder? For the most part, the author succeeds in demonstrating that the twenty-first century requires a definition of community that includes environmental, social, and spiritual concerns. In a format particularly [End Page 265] helpful for undergraduate teaching, he carefully rehearses at the end of each section three central questions: how does this thinker contribute to our understanding of community? Does his approach lead to the diminishment of violence? Does it facilitate peace?For the first quarter of the book, Herman explores various aspects of community. Drawing from Erich Fromm, Socrates, and Aldous Huxley, he demonstrates that out of enlightened self-interest, all people seek peace for themselves. He is careful to point out, however, that the Socratic virtues of wisdom, courage, self-control, and justice, which arise from within, are far superior to the uniformity of the World State as described in Huxley's Brave New World, which leaves nothing uncontrolled by the external authorities. Both lead to nonviolence and peace, but the World State can fall prey to what Fromm terms cultural insanity.Supplementing his discussion of Aldo Leopold with references to the work of Rachel Carson and J. Baird Callicott, Herman emphasizes that ideas of community peace must be informed by holistic structures of nature, particularly as articulated in Leopold's Sand County Almanac. However, he also warns that if the welfare of the biotic community takes precedence over all other concerns, then society could fall into a state of ecofascism.Herman's chapter on Mahatma Gandhi ably summarizes the life and works of this great political reformer, with particular focus on his formative years in South Africa. Influenced by John Ruskin and Leo Tolstoy, Gandhi developed the concept of the "Ashramic community," a means of collective, intentional living designed to effect social change. After describing the Phoenix Settlement (1904, Johannesburg), the Sabarmati Ashram (1915, Ahmedabad), and Sevagram Ashram (1933, Wardha), Herman presents a fifteen-page play script based on the Asian travel diaries of Professor George P. Conger, chair of philosophy at the University of Minnesota from 1937-1953. Conger spent two months at Gandhi's ashram in Wardha, India, in 1933, and in the play called "Salt," his students take up issues including the ill treatment of Jews in Germany, the definition of nonviolence, and emphasized, as does Gandhi, the necessity for self-transformation to achieve personal and community peace.Martin Luther King Jr. inspired by the example of Mahatma Gandhi, employed nonviolent techniques to bring about the many successes of the American Civil Rights Movement. Herman provides a brief biography of Martin Luther King Jr., quotes several of his pivotal sermons, and emphasizes the notion of beloved community as critical to King's thinking. He writes that "in King's interpretation of agape, it is your being loved that gives you value; and it is your selflessly loving others that gives them value and makes the beloved community possible" (p. 138). According to King, fear and racial discrimination prevent one from entering into the beloved community. By changing laws, and, more importantly, changing the hearts of individual people, a more peaceful community can be built.The least successful chapter of this book discusses Gautama Buddha and the "karmic community." As the editors fully perceived, the new critical edition of the so-called commentary of Bernardus Silvestris on the Aeneid of Vergil was but a stage in the development of a basic knowledge of this important work. We could not, with the data available to us, solve certain major problems relating to author and text. We could not, for example, confidently name the author, nor could we adequately describe the genesis of the work. Recently, two studies have appeared — the first (...) by E. R. Smits, the second by Christopher Baswell — which seek to address these questions. The present article will in the main be a critique of these studies. In my view the two scholars perform a valuable service in bringing forward new material to which others may react, but the principal suggestion of Smits must be rejected and the conclusions of Baswell require modification. Where Friedrich Schleiermacher left off, Christopher Bruell has dared to set forth. Schleiermacher was the last thinker about Plato to present an order in which the dialogues should be read, on the assumption that an author as careful as Plato must have arranged his diverse works in an intentional order. In 1839 the philologist Karl Friedrich Hermann transformed Schleiermacher’s order of exposition, as intended by Plato, into an order of development of Plato’s thought. Ever since, Platonic scholars have expended (...) more effort in arguing about the order of the dialogues than in anything else. (shrink)

In defending his conception of the Christian political witness, Stanley Hauerwas has claimed theological affinity with Martin Luther King Jr. However, despite their shared commitment to non-violence, Hauerwas's claim is unwarranted. Indeed, King 's witness reveals that Hauerwas's conceptualization of American liberalism and of the friction between Christian convictions and the American political system is in both cases overdrawn. I conclude that Hauerwas must either abandon his effort to claim Martin Luther King as a theological ally, or he must reformulate (...) his conception of American liberalism. (shrink)

The ritual handling of serpents remains an unnoticed cultural form for the explanatory aims and theoretical insights desired by cognitive scientists of religion. In the current article, we introduce the Hood and Williams archives at The University of Tennessee at Chattanooga that contains data culled from Hood’s 40-plus year career of studying serpent handlers. The archives contain hundreds of hours of interviews and recordings of speaking in tongues, handling fire, drinking poison, and taking up serpents by different congregants and congregations. (...) The archive remains a rich but untapped source of data for building, testing, and refining cognitive theories of ritual in general, and serpent handling in specific. We connect Hood’s work to current cognitive theories and engage critically with research on the social functions of ritual. Finally, we discuss several further reasons to pay more attention to SHS communities and practices in cognitive theories of ritual. (shrink)

Arising from four conferences held in Europe and the United States, this volume contains eighteen essays written mostly by Roman Catholics with the exception of select contributions from Jewish, Protestant, and Orthodox perspectives. Most essays pay particular attention to the distribution of scarce medical resources in terms of intensive care units (ICUs) which use some 38% of all medical expenditures in the U.S. each year, one percent of the GNP. The essays often make reference to one another and a wide (...) variety of Catholic perspectives are represented. The essays offer a good reflection of the contemporary state of Catholic moral thought with its strengths and diversity and are nicely framed by the ‘outside voices’ of the non-Catholics represented. When considering the interactions between rhetoric and argumentation, readers of this journal will no doubt be reminded of the seminal work of Henry W. Johnstone Jr. (1959; 1978) who gathered both concerns together in ways that were designed to engage philosophers and persuade them of the intellectual seriousness of both enterprises. He was, of course, a principal force among those who brought Chaïm Perelman’s work to the attention of audiences in North America, and he himself entered into deep and fruitful (...) dialogues with Perelman by way of reviewing the value that rhetoric brought to argumentation and logic, as well as to philosophy generally. The question of the relation of my work to that of Martin Luther King Jr. cannot be resolved with the theoretical tools Christopher Beem brings to the task. Stanley Fish has written that "those who detach King's words from the history that produced them erase the fact of that history from the slate, and they do so, paradoxically, in order to prevent that history from being truly and deeply altered." The vice of liberalism is not selfishness so much as (...) a forgetfulness that spreads like a blight from the habit of abstraction. Martin Luther King Jr. remembered his people, his savior, and his church, and he called the rest of us to share those memories. Therein lay his strength. (shrink)

In an age where issues like climate change and the unintended consequences of technological innovation are high on the ethical and political agenda, questions about the nature and extent of our responsibilities to future generations have never been more important, yet simultaneously so difficult to answer. This book takes a unique approach to the problem by drawing on diverse traditions of thinking about care (including developmental psychology, phenomenology and feminist ethics) to explore the nature and meaning of our relationship with (...) the future. Suppose we believe that God created the world. Then surely we want it to be the case that he intended, in some sense at least, to create THIS world. Moreover, most theists want to hold that God didn't just guess or hope that the world would take one course or another; rather, he KNEW precisely what was going to take place in the world he planned to create. In particular, of each person P, God knew that P was to exist. (...) Call this the "standard" conception. Most theists find the standard conception appealing. Unfortunately, the view seems to conflict with the equally appealing idea — call it "temporal actualism" — that there are no "future" individuals beyond those that already exist in the present moment. For, on this view, for any historical person P, prior to creation, there was no such person as P and hence nothing about P for God to know. Hence, in particular, God couldn't have known that P was to exist. This is of course not a new problem. But past solutions to it are highly problematic. In this paper, after canvassing previous approaches, I will propose a solution that seems to preserve both temporal actualism and a suitably robust form of the standard conception while avoiding the pitfalls of the past. Aristotle attaches particular significance to the homonymy of many central concepts in philosophy and science: that is, to the diversity of ways of being common to a single general concept. His preoccupation with homonymy influences his approach to almost every subject that he considers, and it clearly structures the philosophical methodology that he employs both when criticizing others and when advancing his own positive theories. Where there is homonymy there is multiplicity: Aristotle aims to find the order within this multiplicity, (...) and believes that doing so is crucial to scientific inquiry and philosophical progress.Christopher Shields investigates and evaluates Aristotle's approach to questions about homonymy, characterizing the metaphysical and semantic commitments necessary to establish the homonymy of a given concept. Moral error theories are often rejected by appeal to ‘companions in guilt’ arguments. The most popular form of companions in guilt argument takes epistemic reasons for belief as a ‘companion’ and proceeds by analogy. I show that this strategy fails. I claim that the companions in guilt theorist must understand epistemic reasons as evidential support relations if her argument is to be dialectically effective. I then present a dilemma. Either epistemic reasons are evidential support relations or they are not. If (...) they are not, then the companions in guilt argument fails. If they are, then a reduction of epistemic reasons to evidential support relations becomes available and, consequently, epistemic reasons cease to be a viable ‘companion’ for moral reasons. I recommend this structure of argument over existing strategies within the literature and defend my claims against recent objections from companions in guilt theorists. (shrink)

Interpreting Figurative Meaning critically evaluates the recent empirical work from psycholinguistics and neuroscience examining the successes and difficulties associated with interpreting figurative language. There is now a huge, often contradictory literature on how people understand figures of speech. Gibbs and Colston argue that there may not be a single theory or model that adequately explains both the processes and products of figurative meaning experience. Experimental research may ultimately be unable to simply adjudicate between current models in psychology, linguistics and philosophy (...) of how figurative meaning is interpreted. Alternatively, the authors advance a broad theoretical framework, motivated by ideas from 'dynamical systems theory', that describes the multiple, interacting influences which shape people's experiences of figurative meaning in discourse. Expressions of the form 'S is aware of the fact that p' are commonplace. This book provides a systematic exploration of the relation between knowledge and factual awareness, arguing that knowledge is but one species of factual awareness and that we can understand the possession of objective reasons, the normativity of knowledge, and the nature of knowledge in terms of factual awareness. In this way, the state of factual awareness is, structurally and substantively, a more basic type of state than (...) knowledge. If correct, this undermines a number of ways in which knowledge has been regarded as ‘first’ in recent epistemology. (shrink)
